The decision in Yukos has “major precedential value” for investors in the energy sector in Russia prior to 19 October 2009, says Emmanuel Gaillard – meaning that their investments will continue to be protected for 20 years after that date, despite Russia’s termination of the provisional application of the Energy Charter Treaty.
