Any day now, the European Commission will release its response to the Heidelberg Report. That report suggested removing the arbitration exemption from the Brussels Regulation and replacing it with a new interface between courts and international arbitration. The report has drawn a strong reaction in some quarters. Here, Peter Schlosser, professor emeritus at the University of Munich, who helped write the report, defends it.
