9.40: Session One: Arbitration and China - what now and what next?
With more than 200 arbitration bodies administering thousands of cases, the "Middle Kingdom" has the potential to be one of the centres of gravity for arbitration. But have recent events within CIETAC altered that? Are Chinese institutions entering an era of"Warring States"? What problems have been created - and how can they be navigated?
Then there's HKIAC. It has new rules, new hearing facilities - but also a new local neighbour, CIETAC. Is HKIAC's position as the leading Chinese dispute resolution centre assured - or are others, including Singapore and the ICC, successfully moving onto its turf?
The chair of the panel will provocatively question leading names from the region on what the future holds when it comes to China and arbitration.

2.15pm: Session Three: Dispute resolution for Outbound Asian investment
Chinese outward investment is now a significant global trend. What traps do Chinese companies need to avoid? A panel of international speakers will be asked to imagine that they are advising a Chinese energy business about to invest in a joint venture abroad, and to give brief presentations based on the four headline points they would put in their client-memo. Presentations are expected to cover
- issues surrounding arbitration clauses
- the best neutral seats for that jurisdiction
- traps for the unwary
- discovery
The session will also include segments on how to structure an investment for treaty protection and lessons to be drawn from current international disputes featuring Chinese companies.
