GAR live - An attempt to predict the future

Once, a leading commercial arbitrator speaking publicly about his work would have been unthinkable to aficionados. But recently three of the biggest names did just that - in a live Q&A - and were widely applauded for the step. As that occasion, and other developments attest, the world of international arbitration has come along way, both in attitude and technique. But what does the future hold?

Five years ago, a news-and-views service that was in its own way a little revolutionary - Global Arbitration Review - started publishing. This October, and entering its fifth year, it will host a live event where dependable speakers from among the world's leading names will attempt to predict just that.

Looking ahead 25 years, they'll analyse why the current leading arbitral seats enjoy success and whether each will be able to cling on to its unique niche; they'll discuss various current innovations in a symposium session - focussing on which seem set to endure; before concluding with an Oxford-style debate on the very future of international arbitration procedure. Is the current 'standardized' format - on offer wherever you are, seemingly - a successful product, or an evolutionary wrong-turn that would be better off extinct?

The event will take place within walking distance of the Freshfields lecture (later the same day). It will finish an hour before registration for the lecture opens.

9:00 Session 1 - Survival of the fittest - How will Darwinian competition affect London, Paris, Hong Kong, Singapore and other seats?


Leading individuals will take up a particular city and analyse the secret of its success (or lack thereof). They will consider, does it have a niche?, do those who promote it understand its niche and will it retain that in the face of competition? What other niches could it strive to occupy?

A symposium session to consider questions submitted in advance by the audience. Questions are invited in particular on recent innovations such as third party funding and on proposals for how arbitration should seek to evolve in the future - such as migrating away from the party-appointed arbitrator.

An Oxford-style debate on the proposition: "international arbitration procedure has become overbuilt with guidelines and best practice, becoming a hybrid of many systems that is more monster than masterpiece."
