The programme includes two debates, a symposium session moderated by the director general of the LCIA, and a special panel on troubleshooting international arbitration with a nexus to India.

Session 1

Institutions in Asia– survival of the fittest in action. Who’s succeeding in the region and what’s their competitive advantage?

Which institutional providers are gaining a foothold in Asian practice? Leading names will be asked to ‘adopt’ an institution, and explain why it is selected in contract negotiations. But in the spirit of "nothing is finished, nothing is perfect and nothing is forever" they'll also be asked to review its vulnerabilities. Presenters will be quizzed intensively by the chair, and then the audience.

Session 2

Symposium: current trends - will they last?

A group discussion of questions submitted by the audience, led by two leading authorities. Questions will be sought on current talking points, but certain subjects are bound to crop up - challenges to arbitrators, use of expert witnesses effectively, costs, the direction of investment arbitration, enforcement of awards, and third-party funding.

Session 3

India - where is international arbitration going?

Policy makers and judges in India now declare their commitment to international arbitration, but are the actions on the ground keeping pace with those words? Anecdotal evidence remains unclear, and some Indian cases still appear to follow a law of their own. As Indian corporations are leading Asia's presence on the world stage, the conference's showpiece session will delve into problems and solutions guided by a unique panel.

Subjects presenters will cover include:

- the latest case law (on court intervention in a) India-seated international arbitrations and b) foreign-seated international arbitgration with an Indian party).

- the difficulties that still arise during an international arbitration processes with an Indian aspect.

- latest governmental thinking.

- rules on foreign lawyers appearing on Indian soil in international arbitrations.

- tax issues about arbitral earnings.

- investment arbitration as an option.

- the LCIA and SIAC’s efforts - are they having the intended effect?

- realistic solutions to remaining problems
